1. Acceptance of Terms

• These Terms and Conditions (Terms) govern your access to and use of Petometo’s apps, websites, and services (Platform). • By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. • If you do not agree, you must not access or use the Platform. • We may update these Terms from time to time; continued use after updates constitutes acceptance of the revised Terms.

2. Definitions

• Pet Parent: A user who requests or purchases services or products via the Platform. • Service Provider: A vet, groomer, walker, caretaker, delivery partner, or other professional offering services via the Platform. • Marketplace/Shop: The affiliated e-commerce experience within the Platform. • Booking/Order: A confirmed request for services or products placed via the Platform. • Rewards/Promotions: Non-cash benefits (e.g., coupons, credits) offered under specific criteria or referral programs.

3. Eligibility & Accounts

• You must be at least 18 years old and capable of entering into a binding contract. • You agree to provide accurate, current, and complete information and keep it updated. • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. • Notify us immediately of any suspected unauthorized access or security breach.

4. Service Provider Registration & Compliance

• Service Providers must provide truthful information, including qualifications, certifications, licenses, and insurance where applicable. • You represent that you are legally permitted to provide the services in your jurisdiction and will comply with all applicable laws and professional standards. • Petometo may, but is not obligated to, conduct verification checks. Verification does not guarantee safety, fitness, or legality. • Service Providers are independent contractors, not employees, partners, or agents of Petometo.

5. Platform Role (Marketplace Intermediary)

• Petometo is a technology platform that facilitates discovery, matching, communication, and payments between Pet Parents and Service Providers and enables affiliated marketplace purchases. • Petometo is not a party to any agreement between users, nor does it control the performance, quality, timing, legality, or suitability of services or products. • Except where expressly stated, Petometo does not provide veterinary, grooming, walking, or caretaking services itself.

6. Service Standards

• Service Providers must perform services safely, humanely, and professionally, consistent with descriptions and qualifications shown. • Pet Parents must provide accurate pet information (health, behavior, vaccination status) and safe access to premises where required. • Either party must treat the other with respect and refrain from abusive, discriminatory, or harassing conduct. • Misconduct may result in suspension or termination of account access.

7. Bookings, Cancellations & No-Shows

• Booking details (date, time, scope, price) will be displayed before confirmation. • Cancellation and rescheduling policies may vary by service and will be shown at checkout; applicable fees may apply. • No-shows or late arrivals may result in charges as per the displayed policy. • Emergency vet services are subject to availability; in life-threatening situations, contact local emergency services immediately.

8. Payments, Fees & Taxes

• Payments are processed via secure third-party processors; platform and service fees are shown prior to checkout. • You authorize Petometo and its payment partners to charge your selected payment method for all amounts due. • Refunds, if any, are governed by the applicable refund policy displayed per service/order. • You are responsible for applicable taxes; Service Providers are responsible for reporting and remitting their taxes.

9. Tips, Gratuities & Anti-Bribery

• Voluntary tips/gratuities to Service Providers are permitted where allowed by law and must not be used to obtain improper advantages. • Bribes, kickbacks, or any improper payments or inducements are strictly prohibited. • Soliciting or accepting bribes is grounds for immediate account termination. • Report suspected bribery or corruption to Petometo via the Contact Us details.

10. Rewards, Referrals, Promotions & Free Trials

• We may offer rewards, referral bonuses, coupons, credits, or free trials at our discretion and under specific criteria. • Rewards and promotions are not cash, have no cash value, are non-transferable, and may be capped, time-limited, or revoked for suspected abuse or fraud. • We do not pay users money for using the app or participating in a free trial. • Referral benefits apply only when stated criteria are met and are subject to verification. • We may modify or discontinue any promotional program at any time.

11. Pet Health, Emergency & Tele-Vet Disclaimer

• Tele-vet/video consultations may be limited by the inability to physically examine the pet and are not a substitute for in-person emergency care. • In emergencies or when advised, seek immediate in-person veterinary assistance. • Medical outcomes are not guaranteed; Service Providers, not Petometo, are responsible for medical advice and services rendered.

12. Pet Theft, Loss, Injury, or Death

• Service Providers are solely responsible for the pets in their care during booked services. • Petometo is not liable for any pet theft, loss, escape, injury, illness, or death occurring during or related to services performed by Service Providers or due to conditions at the Pet Parent’s premises. • GPS tracking and safe-zone alerts are convenience features and may be inaccurate due to device or network limitations. • We assist by sharing booking info with law enforcement if required but do not provide compensation.

13. Insurance & Risk Allocation

• Affiliated insurance offerings may be available. • Petometo is not an insurer and does not underwrite coverage. • Users assume risks associated with engaging services. • All claims are handled by the insurance provider.

14. User Conduct & Prohibited Uses

• Do not use the Platform for unlawful activities. • Do not misrepresent qualifications or impersonate others. • Do not post illegal, harmful, or infringing content. • Violations may lead to account termination.

15. User Content, Reviews & License

• By submitting content (photos, reviews), you grant Petometo a worldwide, non-exclusive license to use it. • You are responsible for your content. • We may moderate or remove content that violates policies.

16. Intellectual Property

• The Platform, including logos, trademarks, and software, is owned or licensed by Petometo. • You may not copy, modify, or reverse engineer any part of the Platform.

17. Location Services & Devices

• Some features require location access. • Disabling permissions may limit functionality. • Network and device issues may affect accuracy or performance.

18. Third-Party Services

• Platform integrates third-party services (maps, payments, analytics). • Their terms and privacy policies apply. • Petometo is not responsible for third-party content or failures.

19. Privacy

• We process data as described in the Privacy Policy. • By using the Platform, you consent to such processing. • You are responsible for obtaining pet-related consents if required.

20. Disclaimers

• Platform is provided on an 'as is' basis. • No warranties of accuracy, availability, or fitness for a purpose. • We do not guarantee service performance or information completeness.

21. Limitation of Liability

• Petometo is not liable for indirect, incidental, or punitive damages. • Maximum liability: higher of INR 5,000 or fees paid in last 3 months.

22. Indemnification

• You agree to indemnify Petometo against claims arising from your actions, content, or violations of these Terms.

23. Termination & Suspension

• You may stop using the Platform anytime. • We may suspend or terminate accounts for violations. • Certain obligations continue after termination.

24. Changes to Terms

• We may update Terms at any time. • Continued use after updates means acceptance.

25. Governing Law & Dispute Resolution

• Governed by laws of India. • Courts of Pune, Maharashtra have jurisdiction.

26. Force Majeure

• We are not responsible for delays caused by events outside reasonable control (natural disasters, outages, strikes, etc.).

27. Miscellaneous

• If any provision is invalid, others remain enforceable. • Failure to enforce is not a waiver. • You cannot transfer rights without permission. • These Terms + Privacy Policy = full agreement.
